CRONOMETRAS Terms of Use

Please read these Terms of Use carefully before accessing or using the Cronometras application (hereinafter, the "Application"). By accessing or using the Application, you agree to be bound by these terms and conditions. If you do not agree with all the terms and conditions of this agreement, then you may not access the Application or use any of its services.

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you (the "User") and the provider of Cronometras (hereinafter, "We" or "Cronometras"). By accessing and using the Application, you confirm that you have read, understood, and agreed to be bound by these Terms of Use, as well as our Privacy Policy.

2. Service Description

Cronometras is an application designed to facilitate time studies in work environments. The Application allows users to:

• Create and manage time studies.
• Define work elements that make up a process, even using a library of predefined elements.
• Measure the time spent on executing these elements, both in a repetitive and continuous manner, as well as in machinery operations and elements with variable frequency.
• Adjust measured times by the activity rate of the operator.
• Apply allowances to compensate for fatigue and other delays, using systems such as ILO or TAL Tables.
• Calculate fatigue for machine elements.
• Generate detailed reports with the results of the studies, including normal times, standard times, estimated production, and other key indicators.
• Manage your user profile, including language preferences and time units.
• Collaborate with other users through organization management and study sharing.

3. Application Access and Use

• To use the Application, you must create a user account by providing accurate and complete information.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to use the Application in accordance with these Terms of Use and all applicable laws and regulations.
• You commit not to use the Application for illegal or unauthorized purposes.
• Cronometras reserves the right to modify, suspend, or discontinue access to the Application or any of its functionalities at any time, with or without prior notice.

4. Intellectual Property

• The Application and its content, including but not limited to software, design, text, graphics, logos, and images, are the property of Cronometras or its licensors and are protected by applicable intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Application for your internal time study purposes.
• The reproduction, distribution, modification, creation of derivative works, public display, or any other form of exploitation of the Application's content is strictly prohibited without the prior written authorization of Cronometras.

5. User Content

• When using the Application, you may enter data and information related to your time studies, such as study names, element descriptions, measured times, activity adjustments, allowances, and comments (hereinafter, "User Content").

• You retain ownership of your User Content.

• You are solely responsible for the accuracy, quality, integrity, legality, and reliability of your User Content.

6. Study and Data Management

• You acknowledge that you are the owner of the studies you create.
• Only the owner of a study has the ability to edit or completely delete it.
• You can share studies with other members of your organization, who may have different levels of access and permissions.
• Security measures are implemented to protect your data, including synchronization with Supabase and Row Level Security (RLS).
• Cronometras is not responsible for the loss or corruption of data that is not directly caused by a technical failure attributable to the Application and not resulting from User actions. We recommend making backups of your important information.

7. Credit System (if applicable)

• The use of certain functionalities of the Application may be subject to a credit system.
• You will be informed about your available credit balance and the costs associated with different actions.
• Cronometras reserves the right to modify the credit system at any time, including the number of credits required for certain actions and how to acquire additional credits.

8. Limitation of Liability

• The Application is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• To the maximum extent permitted by applicable law, Cronometras will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, without limitation, loss of profits, data, use, goodwill, or other intangible losses) resulting from your access or use of the Application, even if Cronometras has been advised of the possibility of such damages.
• Cronometras does not guarantee that the Application will be uninterrupted or free from errors, viruses, or other harmful components.

9. Indemnification

• You agree to indemnify, defend, and hold harmless Cronometras, its affiliates, officers, directors, employees, agents, and licensors from and against any claim, liability, damage, loss, cost, expense, or fee (including reasonable attorneys' fees) arising from or related to: (a) your use of or access to the Application; (b) your violation of these Terms of Use; (c) your User Content; or (d) your violation of any third-party rights.

10. Modifications to the Terms of Use

• Cronometras reserves the right to modify these Terms of Use at any time by posting the modified terms on the Application. It is your responsibility to periodically review these Terms of Use. Your continued use of the Application after the posting of the modified terms will constitute your acceptance of such modifications.

11. Applicable Law and Jurisdiction

• These Terms of Use shall be governed by and construed in accordance with the laws of Spain, without giving effect to any principles of conflicts of law.
• Any dispute arising under these Terms of Use or in relation to the Application shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain.

12. General Provisions

• If any provision of these Terms of Use is deemed invalid or unenforceable, such provision shall be modified to the extent necessary to make it valid and enforceable, and the remaining provisions of these Terms of Use shall remain in full force and effect.
• The failure or delay by Cronometras to exercise any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
• These Terms of Use constitute the entire agreement between you and Cronometras regarding the use of the Application and supersede all prior or contemporaneous agreements and understandings, whether written or oral.
